Governing Terms of Service
These terms govern the use of New Home Kenya by all users, including tenants, prospective buyers, landlords, property managers, and verified real estate agents under the Laws of Kenya.
1. Agreement to Terms
By accessing, browsing, registering on, or posting to New Home Kenya ("the Platform"), you confirm that you are at least 18 years of age and agree to be bound by these Terms and Conditions and all applicable Kenyan laws. If you do not agree, you must immediately discontinue use of the platform.
2. Marketplace Role & Physical Due Diligence Disclaimer
New Home Kenya operates as a digital marketplace connecting property seekers with advertisers (landlords, sellers, property developers, and real estate agents). The platform is not an owner, landlord, or estate agent for third-party properties unless explicitly stated.
3. Listing Standards & Advertiser Warranties
Any user who submits or advertises a property on New Home Kenya expressly warrants and represents that:
- They are the lawful registered owner of the property or possess written authority from the registered owner to advertise the property.
- The asking price (rent or sale price) is accurate, genuine, and free from hidden charges.
- All uploaded photographs are recent, authentic, and represent the actual physical condition of the property.
- The property complies with the Land Registration Act 2012, the Sectional Properties Act 2020, and local physical planning zoning regulations.
- They will promptly update or archive listings when a property is let, under contract, or sold.
4. Verified Agent Status
A "Verified Agent" badge is an administrative accreditation based on identity, phone, and business permit validation. While we perform background checks, the badge does not constitute an absolute guarantee or financial warranty by New Home Kenya. Users must exercise standard commercial caution in all property dealings.
5. Airbnb & Short-Stay Bookings
Hosts offering short-stay or vacation rentals must provide accurate availability calendars, clean and sanitary accommodation, verified security amenities, and adhere to local hospitality regulations. Guests agree to comply with house rules, noise restrictions, and designated check-in/check-out hours.
6. Intellectual Property
All software, brand logos, user interface designs, map icons, and proprietary algorithms on New Home Kenya are the exclusive intellectual property of Royalmark IT Experts. You may not copy, reverse-engineer, frame, or scrape any content without prior written authorization.
7. Account Suspension & Listing Takedown
We reserve the right, without prior notice or liability, to suspend, terminate, or delete any account or listing that violates our Property Listing Policy, engages in fraudulent activity, demands illegal viewing fees, or publishes misleading representations.
8. Dispute Resolution & Governing Law
These Terms and Conditions are governed exclusively by the Laws of the Republic of Kenya. In the event of any dispute arising out of or in connection with the platform, the parties shall first attempt to resolve the matter amicably through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be submitted to the competent courts of Kenya in Nairobi.
